What is Airport Liability Insurance?

Liga Asuransi – As we already know, there are many plane accidents that have occurred in Indonesia. The incident on the plane that was horrendous and is still remembered is the Boeing 737 Max-8 plane crash in 2018 that crashed in the waters of Tanjung Karawang, West Java. This incident killed 181 people along with passengers and 8 crew members. This incident caused a huge loss.

The results of several studies on aviation accidents, show that plane crashes are never caused by a single cause, there are always several related factors and contributions. Airplane accidents cause great loss of life and loss of property of people.

In its implementation, the type of loss and the amount that can be compensated are often a problem because the limited liability of the parties is not clear. However, each person (nature or territory) must be legally responsible for their actions that result in harm to others.

The party causing the loss must pay for the loss suffered by the damaged party while complying with the principle of liability based on fault (based on failure of liability) which emphasizes the causal relationship that caused the loss.

Airport Liability Insurance is designed to protect airport managers from losses that may arise due to claims for all commercial activities at the airport. Airport operators must anticipate the potential risks that arise when entering into an airport liability insurance agreement.

The Airport Liability Insurance Policy provides guarantees to airport owners and managers in the event of an accident, injury and death to a person or damage to goods and property belonging to others while in the airport area, either due to an accident in the terminal or an accident due to a fall. airplane on the runway.

Type of airport insurance (Type of Airport Liability policy)

Airport services are grouped into several classifications. An airport that operates as an airport for commercial and scheduled flights where services are provided in addition to landing aircraft, passengers and also refueling which can cause oil spills.

Airport Premises Liability (APL)

Insurance policy provides protection to owners and operators from losses resulting from claims for selecting and using airports, activities that are separate from airports, lifts and escalators.

This guarantee also includes hazards in the airport area, including those caused by aircraft. There are two types of APL insurance policies, namely Owner’s Landlords and Tenants (OL&T) and Comprehensive General Liability (CGL). OL&T guarantees are more limited and more suitable for small airports, while for large airports CGL is used more.

Exceptions to Airport Liability Insurance

There are exceptions that are not guaranteed in Airport Liability Insurance, namely:

  1. Body Injury to any person who at the time of sustaining the Body Injury is involved in the service of the Insured, or liability for which the Insured or their insurance company may be held liable under the employer’s obligations , workers’ compensation, unemployment compensation or disability benefit laws or similar laws.
  2. Liability borne by the Insured under an agreement in any contract unless such liability will be attached to the Insured even though there is no such agreement.
  3. Property Damage to property owned, leased, leased, or occupied by or in the care, custody or control of the Insured other than Property Damage
  4. Body Injury or Property Damage caused by ships, ships, aircraft or aircraft owned, chartered, used or operated by or because of the Insured.
  5. Liability arising out of the possession, use, consumption or handling of any goods or products manufactured, constructed, modified, repaired, maintained, maintained, sold, supplied or distributed by the Insured, after such goods or products are no longer in the possession. ownership or under the control of the Insured.
  6. The cost of repairing or replacing defective goods or products manufactured, constructed, modified, repaired, maintained, maintained, sold, supplied or distributed by the Insured or any part or parts of the defective.
  7. Losses arising from improper or inadequate performance, design or specifications but this exclusion does not apply to Body Injury or Damage to Property hereby insured resulting therefrom.
  8. Fees for repairing faulty work, but this exclusion does not apply to Personal Injury or Property Damage arising from such faulty workmanship.
  9. Personal Injury or Property Damage caused by the use of any vehicle on the road that requires separate insurance or security subject to domestic or international laws governing road traffic or, in the absence of applicable law, to liability arising from the use of any vehicle on public roads.
  10. Personal Injury or Property Damage arising from the construction, demolition or alteration of buildings, runways or installations (other than normal maintenance operations).
  11. Responsibilities arising from operating an aerodrome control tower or providing air traffic control services.
  12. Bodily Injury or Property Damage arising out of any air race, or air show or any form used for the accommodation of spectators in connection therewith.

Personal injury and damage to goods that arise as a result of ownership or use of goods and products, made, repaired, serviced, maintained and so on by the insured or his employees but only applies to products that have become part or have been used in connection with the aircraft and if the goods is no longer under the supervision and maintenance of the insured

Damage and loss to the aircraft and its equipment but to aircraft owned or leased by the airport operator or aircraft that are under the supervision and responsibility of the operator or aircraft under repair in the hangar belonging to the insured

The Airport Liability insurance policy provides protection and compensation to airport owners and managers as a result of claims from third parties from the following claims:

  1. Body injury, death and other consequences of accidents
  2. Damage to goods and property caused by accidents n that occur within the airport area and during the insurance coverage period caused by the operational activities of the airport.
