2 Insurance Brokers Sanctioned with Restricting Business Activities from OJK

Bisnis.com, JAKARTA — As many as two insurance brokerage companies received business activity restriction (PKU) sanctions from the Financial Services Authority (OJK). They are PT Jakarta Inti Bersama and PT Jasa Advisindo Sejahtera.

Quoting the announcement on OJK’s official website on Thursday (30/3/2023), OJK has imposed a sanction of limiting business activities for a period of 3 months to insurance brokerage company PT Jakarta Inti Bersama.

OJK Deputy Commissioner for Insurance and Pension Fund Supervision Moch. Ihsanuddin said that the imposition of the PKU sanction was because the insurance brokerage company PT Jakarta Inti Bersama did not fulfill 21 provisions in the OJK Regulations (POJK).

One of the provisions referred to is that the insurance broker, whose address is at Gandaria 8 Office Floor 7 Tower Unit I-J, South Jakarta, does not comply with Article 32 paragraph (1) POJK 70 of 2016.

“Article 32 paragraph (1) POJK 70 of 2016, namely the company has not implemented the provisions regarding the provision of clear information or information regarding insurance objects to insurance companies,” said Ihsanuddin.

In addition, the company also does not help the insured to get information regarding the progress of the claim status and does not inform the amount of the claim value to the insured that the insurance company approves.

“By imposing the Sanctions on Restricting Business Activities, PT Jakarta Inti Bersama is prohibited from providing insurance brokerage services until the cause of the Sanctions on Restricting Business Activities has been resolved,” he explained.

However, the OJK stated that PT Jakarta Inti Bersama is still required to settle obligations that have matured.

There is also another insurance brokerage company that has received a sanction of limiting business activities from the OJK, namely PT Jasa Advisindo Sejahtera, with a period of also 3 months.

“The imposition of the sanction for Restricting Business Activities is because PT Jasa Advisindo Sejahtera has not met the minimum equity requirements,” he said.

Furthermore, the company, whose address is at Nucira Building 3rd Floor, Jakarta, is prohibited from providing insurance brokerage services until the cause of the imposition of a Business Activity Restriction sanction is resolved.

“Nevertheless, PT Jasa Advisindo Sejahtera is obliged to continue to settle its maturing obligations,” he said.

Allianz & Maybank Add Waqf Features to Sharia-Based Unit-Linked Products

Bisnis.com, JAKARTA — PT Asuransi Allianz Life Indonesia’s Sharia Unit and Maybank Syariah introduced the waqf feature to Sharia-based unit-linked life insurance products.

MyProtection Bijak II provides protection solutions and long-term investment benefits to realize the financial plans of Maybank Indonesia customers. Meanwhile, this product is equipped with a choice of waqf features, with a maximum that can be donated by 45 percent of the value of insurance compensation and 30 percent of the balance of the investment value.

Business Director of Allianz Life Indonesia Bianto Surodjo said that MyProtection Bijak II is the first Sharia-based unit-linked life insurance to launch on the market by implementing the latest Financial Services Authority Regulation (POJK).

“The sales process to feature products are by the new POJK, and of course, this provides better transparency to customers,” Bianto said at a press conference for the Grand Launching of MyProtection Bijak II – Waqf Feature in Jakarta, Thursday (30/3/2023).

Bianto stated that Allianz Life Indonesia is committed to protecting the customers of Maybank Indonesia with quality products and services.

Furthermore, Bianto explained that through the MyProtection Bijak II product, the Allianz Life Indonesia Sharia Unit protects Sharia-based life insurance until the customer is 100 years old and added 13 additional benefit options (riders) that can be selected according to customer needs.

“This product allocates periodic basic contributions since the first policy year as investment funds so that customers can develop a wealth portfolio through potential long-term investment value,” he added.

Head of Maybank Indonesia Shariah Banking Romy Buchari said this product resulted from innovation by the Allianz Life Indonesia Shariah Unit and Maybank Syariah to provide something different by providing additional value to customers.

Meanwhile, in managing waqf, Allianz works with waqf management institutions (Nazhir) that are registered with the Indonesian Waqf Agency (BWI), namely Dompet Dhuafa, Waqf Initiative (I-wakaf), Indonesian Waqf House, Waqf IKADI, Baitul Maal Muamalat, Independent Waqf Board, Al-Azhar Waqf, and Yakesma.

AAUI Prepares Draft Proposed Regulations for Electric Vehicle Insurance

Bisnis.com, JAKARTA – The Indonesian General Insurance Association (AAUI) targets to be able to submit proposals for electric vehicle insurance regulations to the Financial Services Authority (OJK) before the end of semester I/2023. With this proposal, more detailed regulations can be enforced in the second half of this year.

“The target was submitted before semester I and semester II can be implemented for members,” AAUI Chairman Budi Herawan told Bisnis, Monday (27/3/2023).

He continued that electric vehicle insurance regulations are still in the data review stage. He also hoped that after this was completed, AAUI could propose rules to the OJK.

On the other hand, Executive Director of the Indonesian General Insurance Association (AAUI) Bern Dwiyanto previously said several companies had protected electric vehicles. Even so, it still uses the same coverage as conventional cars.

AAUI, he said, will continue to push for electric vehicle insurance regulations, which are also in line with the Government’s program in launching the Acceleration Program for Battery-Based Electric Motorized Vehicles (KBLBB) towards environmentally friendly and sustainable development.

According to him, the motor vehicle insurance business line is predicted to be still one of the main contributors to the general insurance industry’s premiums.

“The performance of general insurance is optimistic that this line of business can grow positively last year, as the automotive industry starts to stretch, both conventional and battery-based vehicles, which are increasingly busy with production and demand,” Bern said when contacted by Bisnis, Friday (17/3/2023).

Bern added that insurance for electric cars must be examined further in the future, considering that the Indonesian government has a big agenda regarding renewable energy. Indonesia is targeting to become a significant player in the battery supply chain.

“To support the above, AAUI considers it necessary to conduct a study of the KBLBB risk considering this is a new type of risk,” he added.

Bern said the development of electric vehicle insurance certainly takes time because it needs to be studied more deeply. Moreover, the risks will differ from conventional cars, so insurance companies must be even more careful.

Including the scope of protection, costs, and risk management, which must be considered more specifically. Bern said AAUI had also formed a working team to accelerate electric vehicle insurance last January.

The team’s tasks include conducting studies on applying KBLBB insurance products abroad, conducting discussions/FGDs with related parties, including regulators, and ATPM, to workshops, and compiling KBLBB insurance studies, including Terms & Conditions which include wording, premium rates, and deductibles. Meanwhile, the latter conducted outreach to AAUI members on the studies that had been prepared.

Economist: Indonesian People Are Less Interested in Travel Insurance Products

KONTAN.CO.ID – JAKARTA. Travel insurance is one of the things that need to be prepared for people who want to travel back and forth to Eid.

However, Director of the Center for Economic and Law Studies (Celios) Bhima Yudhistira said the Indonesian people are still not interested in buying travel insurance because the protections offered are already doubled in other insurances.

He said that many still think there is insurance or BPJS health as a substitute for travel insurance related to personal safety. Then for travel insurance related to vehicles, there is already insurance attached to the vehicle from the time it was purchased.

The low literacy of the Indonesian people about insurance, especially for specific travel insurance, is also one of the factors causing this lack of interest.

In addition, insurance companies are also still less aggressive in conducting promotions.

Bhima views that the trend of selling travel insurance in Indonesia is usually a package with a ticket. Because the purchase of travel tickets will be accompanied by insurance protection, sales of travel insurance will also increase, such as ahead of the Eid homecoming later.

“I think for travel insurance because it correlates with increased ticket sales in various modes of transportation, travel insurance also increases, but that’s about it,” Bhima told Kontan.co.id, Monday (27/3).

“Travel insurance is usually bought in a package with the ticket. The trend in Indonesia is still like that,” he added.

This trend differs from the style of selling overseas travel insurance, which is easy to modify. For example, buy insurance for three days if you want to go out for three days.

“So it’s not as big as a portion of a flight ticket or train ticket. But it is tailored to individual or personal needs,” he said.

Then the insurance rate abroad also adjusts the destination. For example, insurance rates will differ if we go from one city to another.

Observing Insurance Readiness for Spin Off Obligations of Sharia Business Units

KONTAN.CO.ID – JAKARTA. The Indonesian Sharia Insurance Association (AASI) stated that insurance companies are preparing to comply with regulations regarding the separation of sharia business units (UUS) or spin offs.

In addition, if the Financial Services Authority Regulation (POJK) regarding spin offs is issued, many companies will be subject to spin off obligations.

As is known, after Law No. 4 of 2023 concerning the Development and Strengthening of the Financial Sector (UUPSK) was issued, the Financial Services Authority (OJK) is preparing derivative regulations including the POJK regarding the spin off of the sharia business unit of insurance and guarantee companies.

Head of the Department of Insurance Supervision and Non-Bank Financial Industry Support Services (IKNB) OJK Dewi Astuti said, based on the P2SK Law, the POJK on spin offs had to be issued 6 months after it was promulgated.

“So, it’s currently being processed and discussed,” said Dewi to Kontan.co.id, Saturday (25/3).

OJK targets this POJK to be completed no later than 6 months or on 12 July 2023, after the PPSK Law was officially promulgated on 12 January 2023.

Furthermore, this UUS spin-off POJK will contain substances related to more precise and measurable indicators. OJK also encourages that the UUS spin-off process is not solely implemented with consideration of obligations based on regulations alone but also based on the readiness of the UUS itself.

OJK hopes that UUS, chosen as the spin-off, will grow sustainably and make a more optimal contribution to driving national economic growth.

Meanwhile, Executive Director of the Indonesian Sharia Insurance Association (AASI) Erwin Noekman said that at the beginning of the PPSK Bill, it was as if there was no obligation to spin off UUS. However, after the PPSK Law was promulgated, the obligation to separate Sharia units remained.

“So, from AASI’s point of view, we think that the PPSK Law is an affirmation of the necessity of a spin-off,” Erwin told Kontan.co.id, Friday (24/3).

From AASI’s point of view, this spin-off rule is fundamental as reinforcement and affirmation so that there is no legal vacuum. With the existence of the PPSK Law, there is a promise of the obligation to separate Sharia units, and must be carried out.

“In the near future, we see that several Islamic insurance companies are independent. In addition, several insurance companies have formed corporate shells. There are general insurance and life insurance,” he said.

“In the first semester of 2023, the process is ongoing. Maybe in the second half of 2023, OJK will apply for a business license,” he continued.

Erwin believes that if the UUS spin-off POJK rule is enforced, many companies will be subject to spin-off obligations. Furthermore, this rule is an effort to condition a healthier business climate and to ensure that business actors are earnest about Sharia business.

From a business perspective, the Main Director of PT Asuransi Syariah Keluarga Indonesia (ASyKI) Mudzakir, said the PPSK Law hopes to provide guidelines that make it easier to spin off.

“Of course, there will be more positive impacts, although it is undeniable that other negative sides must continue to be perfected. With so many full fledge sharia, they will share experiences between them and will automatically have fastaqul khairat for better development,” said Mudzakir to Kontan.co.id, Friday (25/3).

Mudzakir said if two or three companies spin off successfully, then psychologically, it will push other companies to spin off as well.

For example, PT Prudential Sharia Life Assurance (Prudential Syariah) has carried out a spin-off. After the spin-off, they will focus on increasing market share and are optimistic that opportunities to increase market share are very wide open.

Apart from that, Allianz Life is also preparing to spin off. PT Asuransi Allianz Life Indonesia’s Sharia unit continues strengthening its strategy to develop its Sharia business. Plus, providing education to increase public awareness and understanding of Sharia insurance.

Managing Director of Sharia Allianz Life Indonesia Achmad Kusna Permana said one of the efforts made by Allianz to develop its Sharia business was training and strengthening marketers.

He detailed that in the initial phase, marketers will be given a series of intensive training. After obtaining an official license from the Indonesian Sharia Insurance Association, marketers will also receive workshops and further training to continue to increase their knowledge.

“With the training and strengthening provided by Allianz, until the end of 2022, sharia licensed life insurance agents have increased by 107.4% compared to the previous year,” said Permana.

Business License Revoked, Wanaartha Life Sues OJK to PTUN Jakarta

KONTAN.CO.ID – JAKARTA. PT Asuransi Jiwa Adhisarana Wanaartha (Wanaartha Life) has officially filed a lawsuit against the Jakarta State Administrative Court (PTUN) against the Financial Services Authority (OJK).

The lawsuit that was registered with PTUN Jakarta on Wednesday (29/3) aims to get the OJK to cancel the revocation of Wanaartha Life’s business license which was previously set on December 5, 2022.

Based on the official PTUN Jakarta website, the lawsuit was registered under number 140/G/2023/PTUN.JKT with the plaintiffs including Hendro Yuwono Salim, Santy Sutanto, Rudy SH, and Armin. The plaintiffs appointed Ervan Susilo Adi Mamonto as the plaintiff’s attorney.

Several contents of the lawsuit were filed with the OJK, including granting the plaintiff’s claim in its entirety.

“Declaring null and void the Decision of the Board of Commissioners of the Financial Services Authority Number KEP-71/D.05/2022 concerning Revocation of Business License in the Life Insurance Sector for PT Asuransi Jiwa Adhisarana Wanaartha dated December 5, 2022,” wrote the contents of the lawsuit, quoted Sunday ( 2/4).

In addition, Wanaartha asked PTUN to order and oblige OJK to revoke the Decree of the Board of Commissioners Number KEP-71/D.05/2022 concerning Revocation of Business License in the Life Insurance Sector for PT Asuransi Jiwa Adhisarana Wanaartha dated 5 December 2022.

Responding to the lawsuit filed by Wanaartha Life, Deputy Commissioner for Supervision of Financial Services Business Conduct and Consumer Protection, Sarjito said, until now, the OJK has not received a summons (relaas) notification of the lawsuit from Wanaartha Life and/or summons from PTUN regarding the case to OJK by the plaintiff.

“Nevertheless, OJK respects the legal efforts made by the parties regarding the ongoing legal process against Wanaartha Life,” Sarjito told Kontan.co.id, Friday night (31/4).

For your information, the OJK revoked Wanaartha Life’s business license after the life insurance company had difficulty paying claims and causing customer losses. This decision was officially ratified by the OJK with number KEP-71/D.05/2022 concerning the Revocation of a Business License in the Life Insurance Sector for PT Asuransi Jiwa Adhisarana Wanaartha dated 5 December 2022.

Chief Executive of Non-Bank Financial Industry Supervision (IKNB) Ogi Prastomiyono said the revocation of Wanaartha Life’s business license was due to the inability to comply with the conditions which led to the imposition of a Business Activity Restriction (PKU) sanction.

Furthermore, sanctions were imposed on Wanaartha Life for violating the minimum solvency level, minimum investment adequacy ratio, and minimum equity not following statutory provisions in the insurance sector.

The OJK also prohibits Wanaartha Life’s corporate organs from transferring, guaranteeing, pledging, or using assets that can reduce company assets’ value.

Viral Former customer admits to being cheated, AXA Mandiri: He understands Unit Linked Insurance.

Bisnis.com, JAKARTA – PT AXA Mandiri Financial Services (AXA Mandiri) responded regarding a video of its former customer, Arbi Alfarisi, and his wife, Dini Indriani, who claimed to be victims of fraud.

In the video circulating, Dini admits that she lost tens of millions of dollars and wants their money back after buying insurance products at the company. AXA Mandiri later denied the accusations made by its former customer.

According to AXA Mandiri Compliance Director Rudy Kamdani, the husband and wife knew that the product being purchased was a unit-linked insurance product. “Including understanding the characteristics of unit-linked products and their benefits and risks.

Based on the documentation signed by the former customer, the customer bought unit-linked products, and 30 percent of the total premium has been taken,” Rudy said in a statement received by Bisnis Sunday (2/4/2023). Rudy added that the rest was expenses. Life insurance protection starts from 2017 to December 2022 with a protection value of up to three times the total premium.

 “The person concerned even bought three policies in different years. When he closed the policy in 2022, we handed over the policy closing funds to the person concerned and he has received the funds,” added Rudy.

Rudi added the former customer then filed a complaint with the Financial Services Authority (OJK) through the Consumer Protection Portal Application (APPK OJK) because he was dissatisfied with the BPKN decision.

“In this case, we have also responded according to a predetermined timeframe. Instead, we asked what was his motive for making a post narrative that gave the impression of being a victim of our company, which is contrary to the actual facts.

At the same time, we ask the public not to immediately believe posts on social media without knowing the actual facts,” said Rudy. AXA Mandiri added Rudy invited the former customer to take the dispute resolution method stated in the policy, namely the Financial Services Sector Alternative Dispute Resolution Institution (LAPS SJK) or the district court.

“Submitting information to the public that is not by the facts and provoking the public with incorrect information is a criminal act and violates the law,” said Rudy.

Previously, videos of netizens claiming to be tricked by Axa Mandiri were circulating on social media. The TikTok account @arbialfarisofficial shared several videos in which he complained to AXA Mandiri.
